Terms of use
The agreement between you and Ana Ultimate Group Ltd, in plain language.
Who you are agreeing with
Brainmaxing is operated by Ana Ultimate Group Ltd, a company registered in England and Wales under company number 17407324, whose registered office is 27 Old Gloucester Street, London, United Kingdom, WC1N 3AX.
Where these terms say we, us or our, they mean Ana Ultimate Group Ltd. Where they say you, they mean the person using Brainmaxing.
You can reach us at support@brainmaxing.net or through the contact form, and you can write to us at the registered office above. These terms and the privacy notice together are the agreement between us.
What Brainmaxing is, and what it is not
Brainmaxing is an educational product. It gives you a self-report Snapshot and a seven-day plan, short attention and memory games you run in your browser, a record of your own runs over time, and written material about learning, attention and evidence.
It is not a medical service. Nothing here diagnoses, treats, cures or prevents any condition, and nothing here is a substitute for advice from a qualified healthcare professional.
It is not an intelligence test and produces no general ability score, no rank and no percentile.
We do not promise any particular outcome. Practising a task makes you better at that task; whether that shows up anywhere else in your life is not something we claim, and you should be sceptical of anyone who does.
Your account
You must be 18 or over to create an account or to buy a plan. If you are younger than that, please do not create one.
We do not use passwords. You sign in by asking for a link and opening it from your email, which means the security of your account is the security of your mailbox. Keep it to yourself, and tell us if you think somebody else has reached your account.
One account is for one person. Do not share it, and do not let someone else use it.
You can delete your account at any time from Settings, and it really is deleted. What that removes is listed in the privacy notice.
We may suspend or close an account that is being used to break these terms or the community rules. If we close a paid account and you have not been dishonest with us, we refund the part of the period you have paid for and cannot now use.
Plans and prices
There is a free plan and there are paid plans — Core and Premium. What each one includes is set out on the plans page, and the boundary between them is enforced by the service rather than described by it.
The free plan is not a trial. It does not end, it does not start charging you, and no payment method is held for it. Every measurement instrument is free, and retaking one is never behind a plan.
The price of each plan, its currency and its billing period are shown on the plans page and again at checkout before you pay. Prices are never stated in these terms, so that the page you buy from and the terms you agree to cannot disagree.
The price shown at checkout is the price we charge. If tax has to be added, it is shown before you pay, never afterwards.
We may change our prices. A change never applies to a period you have already paid for; we will tell you by email before it takes effect, and you can cancel before it does if you would rather not pay the new price.
Billing and automatic renewal
A paid plan is billed in advance for the period you choose at checkout — monthly or annually. Your plan starts as soon as the payment succeeds.
Your subscription renews automatically at the end of each period, for another period of the same length, at the price then published, and it goes on doing so until you cancel it.
You are told all of this before you pay: what renews, how often, what it will cost, and how to stop it. You confirm that you have read it by ticking a box that we do not tick for you, and we record that you ticked it.
Cancelling is done online, from Your plan in your account, in the same number of steps it took to subscribe. We will never ask you to telephone anyone, write a letter or sit through a retention offer to stop paying us.
Your 14-day right to change your mind
If you are a consumer in the United Kingdom or the European Economic Area, you have 14 days from starting your first subscription to withdraw from it, for any reason and without explaining yourself. This is your right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 in the United Kingdom, and under the Consumer Rights Directive in the EEA.
If you live somewhere else and the law where you live gives you a cooling-off right, you have exactly that right, for as long as that law says. If it says longer than 14 days, longer is what you get. We will never give you less time than the law where you live requires.
You withdraw using the Withdraw from contract control on Your plan, which is there throughout the window. You do not have to use it — an email to support@brainmaxing.net saying clearly that you are withdrawing works just as well — but the control is faster and it takes effect immediately.
When you withdraw, your plan ends at once and we refund everything you paid for it, in full, to the payment method you paid with. We do not deduct anything for the days you had access, even though the law would let us. We would rather have one promise than two.
Your access starts immediately when you subscribe, so that you can actually try the product inside the window. Using it does not reduce your refund.
The window runs from the start of a first subscription. A renewal is not a new subscription, so it does not open a new window of its own — unless the law where you live says it does, in which case you have exactly what that law gives you. See what we say about renewals under Refunds.
Refunds
Inside the cooling-off window described above, you get everything back. That is the withdrawal right, and it is the strongest promise in these terms.
If the law where you live does not give you a cooling-off right, we do not promise one, and cancelling stops your next charge rather than refunding the one you have already made. There is one thing we do for everybody: if you have only just started your first subscription and it was a mistake, tell us within two days of that first payment and we will refund it.
If a renewal charge takes you by surprise, write to us within 14 days of it. We may refund it if you have not used the product in that period — we would rather refund a renewal nobody wanted than argue about it. That is done by hand from the support inbox, not by a control on your plan page.
Otherwise, cancelling stops the next charge and does not refund a period that has already begun. If something has genuinely gone wrong — the service did not work, we billed you twice, we charged the wrong amount — write to us and we will put it right.
Refunds go back to the payment method you paid with, through our payment provider. How long it then takes to appear is your bank's business rather than ours, and it is usually a few working days.
Where the law where you live gives you a stronger right to cancel or to a refund, that law applies and nothing here reduces it.
Cancelling
You can cancel at any time from Your plan, without giving a reason. Cancelling is not harder than subscribing: it is the same surface, the same number of steps, and there is no retention flow in the way.
Cancellation stops the renewal. It takes effect at the end of the period you have already paid for, you keep your access until then, and you are not charged again.
If you change your mind before that period ends, Resume puts the renewal back exactly as it was.
Cancelling does not delete your account or your data. Your runs, your history and your progress stay where they are, and what changes is only what the free plan lets you see. If you subscribe again, everything is still there.
Deleting your account is a different and stronger act. It ends the subscription and removes your data, and it cannot be undone.
Changing your plan
Moving to a higher plan takes effect immediately, and you pay the difference for the rest of the period you have already paid for rather than starting a new one. Moving to a lower plan takes effect at your next renewal, so you keep what you have paid for until the period ends, and you are told the date it changes. Changing between monthly and annual billing follows the same rule: up now, down at renewal.
There is no plan-change control on your plan page yet. Until there is, write to support@brainmaxing.net and we will make the change for you.
If a payment fails
A failed payment does not end anything straight away. A card that expired is not a decision you made, so your access continues for a grace period while the payment is retried, and we tell you what happened and what to do.
If it is still unpaid when the grace period ends, the plan lapses and your account goes back to the free plan. Nothing is deleted: every run, every result and all of your history stay exactly as they are, and they come back into view if you subscribe again.
We never take a payment we did not tell you about, and we never charge you afterwards for a grace period you were given.
Invite days
Days earned by inviting other people are counted in days of membership, never in money. They have no cash value, they cannot be transferred, sold or exchanged for cash, and they are never paid out.
Today they are banked and cannot yet be spent. Redemption is not open, so a balance in your account is a record of what you have earned and not something you can use yet. We would rather say that than let you collect days on an assumption we have not met.
When redemption opens, banked days are added to the end of a paid plan. They will not apply to anything bought as a one-off.
Days expire if they are not used, and we tell you in your account before they do. We can withhold or reverse them where an invite was not genuine — inviting yourself, invented sign-ups, or an invited person who deletes their account straight away.
We can change or end the invite programme by telling you first. Days you have already earned keep their expiry window if we do.
How you may use Brainmaxing
Use it for yourself, lawfully, and do not try to break it. Please do not attempt to disrupt the service, get around the limits on your plan, scrape it at scale, take it apart to rebuild it, or resell the content as your own.
If you take part in the community, the community rules apply. They are shown when you join and again beside the box you write in, and they are short: be specific and kind, make no medical claims, do not compare scores, and do not sell or recruit. Writing about doses or where you got something is allowed — the post goes up carrying a label saying it is your own experience and not advice, and a moderator reads it. Illegal sourcing is removed.
Moderation, reporting, appeals, the privacy controls and deleting your data are never part of what you pay for. They work the same on every plan.
We can hide a post, restrict an account or close one where these terms or the community rules are broken. Tell us if you think we have got it wrong and a person will look at it again.
Two things read what you write in the community. An automatic check runs over every post, every thread title and every chat message before it is stored: it can refuse something and tell you which rule and what to change, hold it back for a person to read, take out a phone number, card number, bank details or e-mail address and tell you it has, or publish something with a label saying it is a member's own experience rather than advice and pass it to a moderator as well. If we hide a post or restrict an account, you can ask us to look again within 14 days, we aim to decide within 7 days, and the person who decides is never the person who made the original call.
Who owns what
The site, the software, the games, the written material and the brand are ours or our licensors'. Your plan gives you a personal, non-transferable right to use them while it lasts, and nothing more.
What you put in stays yours. Your answers, your runs, your history and anything you write are your own, and we do not claim ownership of them.
So that we can run the product, you give us permission to store and process what you put in — and, for anything you post in the community, to show it to the other people there. That permission lasts only as long as we need it to do that, and deleting your account ends it.
We do not use what you write to train anything, and we do not sell it.
Keeping the service running
We work to keep Brainmaxing available, and we do not promise it will never be down. Things break, and maintenance happens.
We may change the product, add things and remove things. Where a change materially reduces what a paid plan includes, we will tell you before it takes effect, and you can cancel and have the unused part of your period back.
If we ever close the service down, we will give you notice, refund the unused part of anything you have paid, and give you time to take a copy of your data first.
Our responsibility to you
If we fail to do what we said we would do, we are responsible for the loss you suffer that was a foreseeable result of it. We are not responsible for losses that were not foreseeable, or for loss caused by something outside our reasonable control.
Brainmaxing is sold for personal use. It is not built for clinical, diagnostic, occupational-screening or research use, and it must not be used to make decisions about anyone's health, employment, education or care.
Brainmaxing is educational, and you decide what to do with what you read here. We are not responsible for decisions you make on the basis of the content.
We never limit our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. If you are a consumer, you have legal rights that these terms cannot reduce, and nothing here tries to.
If something goes wrong
Write to support@brainmaxing.net or use the contact form and tell us what happened. You will get a case reference, and we aim to reply within three working days.
If we cannot sort it out between us and you are a consumer in the United Kingdom or the European Union, you may be able to use an alternative dispute resolution scheme. We are not currently signed up to one, and we will tell you here if that changes. Consumers in the EU can also use the European Commission's online dispute resolution platform.
None of this stops you going to court, and it does not affect your legal rights.
The law that applies
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
If you are a consumer living somewhere else, this does not take away the protection of the mandatory consumer laws of the country you live in, and you can bring a claim in your own country's courts if the law there says you can.
Changes to these terms
We will change these terms from time to time. The date at the top says when they last changed in substance.
If a change materially affects a plan you are paying for, we will tell you by email before it takes effect, and you can cancel before it does. Carrying on using Brainmaxing after that is how you accept the change.
If any part of these terms turns out to be unenforceable, the rest of them still stand.
